RERA Or Consumer Court (Self or Through Advocate): Justice delayed is Justice Denied- RERA- Aims at ensuring speedy dispute Resolution. Since the RERA act has been enacted, the stance that customer cannot go to consumer court has often been taken in legal arguments in consumer courts. The Supreme court has answered the above-mentioned question in a judgment dated 2nd November 2020, passed by the Supreme Court of India in the case of  M/s Imperia Structures Ltd v Anil Patni & Another  (Civil Appeal No. 3581-3590 of 2020), the Supreme Court held that the redressal mechanism/provisions under the Real Estate (Regulation and Development) Act 2016 (RERA) do not act as a bar to complaints under the Consumer Protection Act 1986 (CP Act). So, any aggrieved person can go to Consumer forum or RERA for dispute Resolution. Person here means any individual purchaser (having Registered Agreement) or Association of such purchaser. Now which is better Consumer Forum or RERA, If your...

Buying a Home is an asset or a liability? A house is not asset for house purchaser but its liability. Asset is one which add money and liability is one which takes your money. Definitely house is an asset for Bank if you have bought the same by taking home loan, you will pay interest / EMI and Bank is earning money from your house. Every month you have to pay for maintenance, Municipality taxes, EMI which costs you a huge amount. Many peoples you buy a Flat comes from economically weaker section and they dream of their own house under the burden of lakhs or Crores of Home loan, it's not actually an achievement. I may be little harsh but it's the truth.   The reality is that many people think that house is an asset, they dream of buying a house as an investment, but the problem is they don't know the difference between investment and asset. I am not discouraging you to buy a home, but simply wants to understand you that house is only for your living and don't buy ...

The dark side of Real Estate Brokers / Agents Real Estate Broker / Agent is one who helps the home purchaser to get their dream home, who helps you in negotiations and guide you so that you don't get cheated by blacklisted builders. but the problem is that such Real estate agents and brokers doesn't exist anymore.   Always try to buy a property directly from Owner / Builder or their Sales team, this is because agents get commission of 2% to 3% on the agreement value so they want you to pay higher to get more commission. Reputed builders either not give commission or give only 1% commission and C grade builders give more commission so for agent's good projects is one where they get more commission. Even builders don't show mercy to agents they give higher price with negligeable margin, so you get the property at higher rate if you buy via brokers.      The reputation of brokers is not good because they don't work for customers rather, they work for c...
